1. Introduction and Acceptance

Welcome to PatternForge. These Terms of Service ("Terms") govern your use of the PatternForge mobile application and website at patternforge.app (the "Service"), operated by ZYAGA LLC ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Age Requirement

You must be at least 13 years of age to use PatternForge. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Subscription Terms

4.1 Subscription Tiers

PatternForge offers multiple subscription tiers. Current pricing and features for each tier are displayed within the app and on our website. Prices are subject to change with reasonable notice.

4.2 Billing and Auto-Renewal

  • Paid subscriptions are billed in advance on a monthly basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You will be charged at the beginning of each billing period

4.3 Cancellation

You may cancel your subscription at any time through:

  • Your Apple App Store account settings (iOS)
  • Your Google Play Store account settings (Android)

Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then.

4.4 Refunds

Refund requests are handled by the respective payment provider:

  • iOS purchases: Contact Apple App Store support
  • Android purchases: Contact Google Play Store support

We defer to app store refund policies. We do not process refunds directly.

5. Puzzle Content

5.1 Lichess Puzzle Database

PatternForge includes puzzles sourced from the Lichess puzzle database, which is licensed under Creative Commons CC0 1.0 Universal (Public Domain Dedication). These puzzles are freely available for any use.

5.2 User Data

Your training data, progress, and statistics are associated with your account. You retain ownership of any personal data you provide to the Service.

6. Acceptable Use Policy

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for personal chess training.

6.2 Prohibited Conduct

You agree not to:

  • Circumvent usage limits or restrictions on your subscription tier
  • Use automated scripts, bots, or scrapers to access the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with others
  • Create multiple accounts to circumvent limits or bans
  • Interfere with or disrupt the Service or servers
  • Violate any applicable local, state, national, or international law

6.3 Reporting Violations

Users may report policy violations by contacting us at info@patternforge.app.

7. Third-Party Services

The Service integrates with third-party services including Supabase, RevenueCat, Lichess, Chess.com, Apple, and Google. Your use of these services is subject to their respective terms and policies.

8. Account Termination

8.1 Termination by You

You may delete your account at any time through the app settings or by contacting us at info@patternforge.app.

8.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activity
  • Abuse or harass other users or our staff
  • Circumvent subscription limits or payment systems

8.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • You will lose access to your account and data
  • We may delete your data in accordance with our Privacy Policy
  • Any outstanding subscription fees remain due

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Puzzle ratings or difficulty estimates will be perfectly accurate
  • Defects will be corrected
  • The Service is free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATTERNFORGE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • ANY DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless PatternForge and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Ohio, USA. You consent to the personal jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PatternForge regarding your use of the Service and supersede any prior agreements.
